Liquidation of Banks

June 22nd, 2008 by bhagvatpilotte

By Ashu Felix Tambong The management of a bank is a very complex thing. This complexity coupled with the prevailing problem of corruption has resulted today in the collapse of many banks, we think of the Credit Agricole, BIAO,BICIC etc. The issue of bank liquidation has now become topic and needs some elaboration. It is essential to note that from the onset that a bank in Cameroon may be a partnership or company and can in theory be dissolved in any of the ways that companies and partnerships dissolve. The law regulating banking operations in Cameroon is however more extensive than the law under which it companies are formed and managed. Banks are regulated by a combination of legal regulations and principles derived from regional treaties particularly that of the commission bancaire des etats de l’Afrique central (COBAC). Indeed , it is a commission formed under the COBAC organization that approves the liquidation of a bank. Liquidation is the winding up of the affaires of a bank for the reason of paying off its creditors in order of their preference and distributing what is left to the shareholders. Article 1 of Ordinance No 3 of 17/4/90 states that the rules of liquidation of banks are different from those of the ordinary laws. The principal distinguishing element between the rules for liquidation of a bank and that of ordinary companies is the fact that the liquidation of a bank cannot be ordered by a court, this is because Article 1 of law No 3 of 27/4/90 specifically prescribes that liquidations must be voluntary In practice a bank goes into liquidation when its members by a resolution agree that the bank be wound up. The resolution winding up the bank also appoints a liquidator for the bank. Our banking law in Cameroonian terminology uses liquidation synonymously with the winding up and have varied a far reaching consequences. The most important of these is the insulation of the bank under liquidation from all legal actions by creditors and third parties. By Article 3 of ordinance No 90/005 of19/9/90 all suits and actions pending against a bank in liquidation cease to exist against the bank on the appointment of a liquidator and lie instead against the liquidator. It may be recalled that the banks are destroyed by corrupt officials who give out unsecured loans to friends , family members and political associates. The relevant laws on liquidation appear to be directed at forestalling actions by creditors to recover from the banks in liquidation. Thus ,Article 59 of Law No 08/335 of 12/05/80 puts a limitation of 4 months from date of liquidation from bringing claims to recover capital investments in a bank. Similarly, Article 3 of the Law of 19//09/90 provides for the delay of law suits against banks in liquidation in very wide forms. This law does not say when such actions may be recommenced; hence it is considered unjust. Online Personal Loans For Those With Bad Credit

June 19th, 2008 by bhagvatpilotte

By [http://ezinearticles.com/?expert=Connie_Barker]Connie Barker Bad credit is something that people are having to deal with more than ever before. In a time when fast money is a way of life and getting it now is the mantra it is easy to get yourself backed into a corner credit wise. On top of that the pace of today is faster as well. Folks find themselves trying to balance it all. So if time is the enemy, how do you strike a balance on the important things such as obtaining a personal loan and how do you do this if your credit is challenged? Your answer may be sitting in your computer right now. There are many types of loans available for those who have bad credit. Online personal loans for those with bad credit are designed to be for any purpose that you may need them for and they are fairly easy to get as long as you follow the directions. One reason online personal loans appear to some people is the privacy. If you have bad or questionable credit you dont want to be sitting face to face with someone else trying to justify why they should give you a loan. Going online to apply for a loan takes the embarrassment away and puts you back into the drivers seat. A personal loan usually has a limit as to how much you can obtain. This keeps both the lender and the person borrowing on an even keel. The borrower can take a chance on a person with bad credit without putting themselves too far out there and a lender can attempt to reestablish credit without chancing getting into more hot water. A personal loan is just that, established for what your personal needs are, not based on a set amount. A personal loan allows the borrower to get exactly what they need. Online personal loans are no higher in interest than a typical personal loan. For instance, a typical fixed rate personal loan offered online in the amount of $5,000 over 48 months is approximately 7.9 percent right now; of course the interest rates vary depending on when you apply for and get your loan. The rates for the application process of course may vary depending on which on-line service you use. It takes a bit of research to find the online personal loan that fits your budget and lifestyle. Online personal loans are becoming the norm in a fast paced world and with credit becoming more of an issue for some folks in a ill economy being able to obtain a personal loan, even though you have bad credit, is a plus. Chickens in Your Backyard for Fun or Profit

June 7th, 2008 by bhagvatpilotte

By Barbara Adams A small flock of chickens can become a great living compost pile. And with new understandings of the superiority of grass-fed organic animal products, including higher Omega-3 fatty acids coming from the eggs of such animals, freerange chickens are showing up again on organic small farms, backyard mini-farms, and even urban lots. Chicken tractors are lightweight bottomless portable pens that fit over garden beds. They can be moved through pathways that need clearing and areas where the growing is complete for the season. Wherever the chickens are moved, they eat pests, pest larvae and pest eggs, and weed seeds. They aerate and churn topsoil, rip old garden residue to shreds, and fertilize with their manure, all while dining on an optimal free meal. The chicken tractor can become a sort of moving compost pile, also. If the chickens diet it supplemented with two popular organic gardening substances: seaweed (such as kelp) and diatomaceous earth, their manure will also add vital trace elements to the soil and their health will improve even further. The chicken tractor idea was made popular by the book, Chicken Tractor: The Gardeners Guide to Happy Hens and Healthy Soil by Andy Lee, Good Earth Publications. This book gives details on care, feeding and the building of a variety of simple chicken tractors. How many chickens for a backyard? Chickens have flocking instincts, and enjoy being with members of their own kind. Three can live happily in a smaller area. For fertile eggs its suggested one rooster to every eight to twelve hens. If you can only keep three or four, it’s best to just have laying hens. Do not keep one male with just one or two females together in a closed in area, hell wear them out (I wont go into any more detail). Also, while some roosters are quite docile, they can suddenly tap into their inherent fighting instincts, plus, they have sharp spurs for fighting on their legs. This is not a good idea around homes and neighborhoods with children (or even adults, for that matter). If a chick grows into a rooster that becomes a beloved pet, check with a vet about caponizing him and removing the spurs. Your vet may not be familiar with this procedure. In the olden days, and somewhat still, it was done to roosters to cause them to be less active, more docile, and become larger for future butchering. It was usually done with sharp tools right on the farm. If a vet is willing and skilled, it could be done humanely, although it was usually done to the males at a young age. Celebrity Hair Secrets: How To Get Your Best Hair Color Ever With Celebrity Tips And Products!

June 1st, 2008 by bhagvatpilotte

By Sara Liz Why does celebrity hair always look so perfect?Celebrities have every tip, technique, and product for hair in the world at their disposal. So what are the secrets to hair color bliss? Are they available to us in the real world? Yes they are, and theyre all captured for you below! Celebrity hair color always has two or more colors in it to give it depth, unlike drug store colors with their flat one tone look. A celebritys hair texture is successfully styled into something smooth and shiny if not glass like. There is no frizz or brassiness in sight. So how do they do it? Read on What tips, techniques and products are used when coloring celebrity hair? Celebrities get their hair colored by a professional who specializes in European hair color or corrective color, or is a great artist. The hairstylist will foil the hair, using two or more colors to give the hair depth. Hairstylists will then put a glaze on the hair to seal in the color, to further tone the color, and to make the hair shine. These services are available in many salons. Usually the foiling with glaze is done every 2 to 3 months and can cost anywhere from $100 to $175 on average. A root touch-up and glaze is done every month and can cost between $25 to $100 on average. How do celebrities keep their colored hair looking fresh, without brassiness between colorings? Celebrities love Artec color depositing shampoos! These banish brassiness and keep their hair color looking fresh! Drew Barrymore told Allure magazine: “The best color shampoos I’ve discovered lately are the ones called ARTec. I use half Sunflower, half Walnut. Gorgeous. It comes out like a bronzy caramel chestnut.” Jenna Elfman has changed her blonde hair to red with ARTec’ Strawberry Color Depositing Shampoo. Minnie Driver uses Cocobean to give her brunette hair depth, and fashion designer Donatella Versace mixes White Violet and Lemon Flower to keep her keep her hair platinum blonde. If the hair color has really faded the celebrity will have their hair glazed which tones down the color and make the hair shine between colorings. Celebrities use salon shampoos and conditioners from brands like ARTec and Bumble and Bumble which are formulated for colored hair because these help hold in the hair color for as long as possible and contain protective sunscreens (the sun can bleach out the color, so they wear hats). How do celebrities keep their colored hair looking healthy, smooth and shiny? Celebrities use deep conditioners with protein in them very frequently to keep the hair texture from becoming too porous and rough. They create shine and smoothness by using ceramic irons on the hair, such as the celebrity favorite, the Sedu Flat Iron, or they curl the hair with gel, steam, or Velcro rollers, which hold curls longer than electric rollers. They trim off split ends with regular trims and have the ends of hair rolled under to hide them. Finally the hair is misted with a silicone based shine spray to complete the red carpet hair look! Wow! Professional hair color can get expensive! So what is the closest we can get to a salon-style home hair coloring regimen? For your two-color hair, you can now buy a great product right in your neighborhood drug store! Beauty experts consider LOreal Couleur Experte home hair color kit to be the best hair coloring product in the aisle because it gives you two colors for that multidimensional salon look! You first color your hair with a base shade and then paint on highlights with an easy to use tool. For your glazing treatment, try Clairol Nice and Easy Color Boosting Glaze in a shade recommended for your hair color. Use shampoos and conditioners for color treated hair. Your one splurge should be for the ARTec color depositing shampoo, as brassiness and color fade are no fun! Sara Liz, M.A. is the Editor-in-Chief for Celebrity-Beauty-Secret-Goldmine. Is Being an Ethical Episcopalian Enough?

May 29th, 2008 by bhagvatpilotte

By Sharon Serot Once a month I take my children to a food pantry to do volunteer work. On this particular Sunday we were stocking shelves with a group of Episcopalian Youth. I knew this because each of them was wearing an Episcopal shield lapel pin. Seeing these kids really lifted my spirits. Usually its adults who work in the food pantry and that can become pretty boring for my kids. Now they had the opportunity to work with students their own age. While separating out cans from boxed goods, my son Drew entered into a very interesting conversation with a young man, Henry, who appeared to be about 16 years old. Drew and Henry became fast friends and worked together throughout the morning. When we were finished with our work, we got in the car and on the ride home, he started to share bits and pieces of his morning conversation with Henry. You know, Henry is not so sure if he believes in God, my son informed me. This information kind of caught me off balance. Isnt Henry a member of the Episcopal Youth Group that came to volunteer at the food pantry? I asked confused. Yup, he said, but that really has nothing to do with his volunteering. He does it because he thinks its the right way to do things, he says he does it because he feels its the right thing to do. Now, I believe that part of being a good Episcopalian is being a good person, no question. But thats not the whole ball of wax! There are Christians who claim to be ethical people but who would not necessarily consider themselves to be religious. So my question is, what is their source for goodness? What does an ethical Episcopalian use as the litmus test for good, if not the scriptures? If goodness is defined by the individual, then it follows that morality can also be defined by the individual and thats dangerous. That can lead us down that slippery slope where what I think becomes sacred. Henrys discussion with my son ended up being a real opportunity for our family. It allowed us to explore our own concerns and perceptions on the importance of an ethical framework thats God- based. Imagine how much infinitely deeper Henrys acts of kindness would be if he were sensitized to not only the physical results of his being a good Samaritan, but the spiritual ramifications as well. 5 Tips To Getting Your Ex Back

May 26th, 2008 by bhagvatpilotte

By Natalie Arton At some point of our life, we put an end to the relationship, only to realize that we made a mistake by losing the person that we love. If youve found yourself in such situation, you have only two possible choices: give up on this relationship and move on with your life or start fighting for your love. No matter which variant did you chose you still have to figure out why this has happened? Analyze where the problem was and address it. This will prevent you from repeating same mistakes in the future, whether you decide to stay with your ex or start a new life with a different partner. If you have decided that you want to save your relationship, there some useful tips to getting your ex back. 1. First of all, I want you to understand that if you split with your ex there was a big problem or a combination of different problems that led to a breakup. Any problem requires solution. It is not enough to go to your ex and tell him/her that you are sorry and you understand what you have done wrong. You have to prove him/her that this relationship deserves a second chance by showing what can be done. 2. Getting back together, as well as staying together requires a conscious effort. You can start by improving yourself and becoming a better person that your ex can fall in love again. Cultivate the qualities that your beloved one is attracted to. 3. Dont act too clingy or desperate around your ex, even if you truly miss him or her. It is not going to help. You have to accept full responsibility for your own happiness, by becoming and independent and strong person. If you make another person the center of the Universe and lay your happiness in his/her hands, you lose control over your life. Without getting your power back you cant change or affect the current situation. 4. After you have acquired a full control, start romancing the person that you love all over again. Awake you exs interest to you, by doing things he/she never thought you are capable of, like quitting smoking or going to the opera or signing up for Chinese language course. Make sure, that you are enjoying your life to the fullest, instead of sitting at home and sulking with hurt. 5. When you will get your former boyfriend/girlfriend back, make this relationship a priority in your life. Otherwise in a few months you might return to this article, hoping to win your ex back once again. Consultants - If We Can’t Laugh At Ourselves?

May 17th, 2008 by bhagvatpilotte

By Dennis Schooley There are hundreds of varieties of Consultants these days. We can find Consultants to take care of our diets, our physical well being, our mental well being, and pretty much anything you can imagine when it comes to business. The story below might just indicate that we take ourselves a little too seriously sometimes. A shepherd was herding his flock in a remote pasture when suddenly a brand new Beemer advanced out of the dust clouds towards him. The driver, a young man in a Brioni suit, Gucci shoes, Ray Ban sunglasses, and a Zegna tie, leaned out his window and asked the shepherd, If I can tell you exactly how many sheep you have in your flock, will you give me one? The shepherd looked at the man, then looked at his peacefully grazing flock, and calmly answered, Sure. The yuppie parked his car, whipped out his IBM ThinkPad, connected it to a cell phone, and surfed to a NASA page on the Internet. He called up a GPS satellite navigation system, scanned the area, and then opened both a database, and an Excel spreadsheet with complex macro formulas. He then sent an email on his Blackberry, and after a few minutes he received a response. Finally, he prints out a 150-page report on his hi-tech miniaturized printer in the car, then turns to the shepherd and says, You have exactly 1623 sheep. That is correct, take one of the sheep said the shepherd. He then watches the young man select one of the animals and bundle it into his car. Then the shepherd says, If I can tell you exactly what you do for a living, will you give me back my beast? O.K., why not? answered the man. Clearly youre a consultant sad the shepherd. Thats correct, says the yuppie, but how did you guess that? No guessing required, answered the shepherd. You turned up here, although nobody called you. You want to get paid for an answer I already knew, to a question I never asked, and you dont know a thing about my business. Now give me back my dog. The lesson seems to be to keep my Consulting assignment to the things I know about. I think Im safe because sheep scare me. A house is not a Home without a Gnome

May 14th, 2008 by bhagvatpilotte

By Hugh Harris-Evans When confronted by a garden gnome the common reaction is to hold up your hands in horror and utter an expression of disgust while wondering how anyone can bear to allow such a creature to remain in their backyard. On the other hand we are told on good authority that the gnome population of Southern Germany is close on four million and, when you start looking, there are quite a number visible in the US. Perhaps we should not be surprised by the Germans since gnomes were first created in their country in the early 1800’s. The earliest recorded sighting in England was in 1840 at Lamport Hall, the seat of Sir Charles Isham. It was not until 1872 that gnomes for the garden began to be manufactured in large numbers. According to German folklore gnomes were regarded as good luck charms. They were supposed to help around the house and garden and in rural areas often lived in the rafters of barns where they would keep a watchful eye on the owner’s animals as well as the crops and garden produce. Over the years the German gnome makers honed their skills and became master craftsmen. At its peak the Griebel gnome factory in East Germany produced some 300 different gnome characters. Following the collapse of communism in 1989 entrepreneurs in the Czech Republic decided to enter the market and to produce cheap imitations of the traditional characters. Initially they were prevented from entering Germany by a law which allowed customs to confiscate those gnomes infringing companies’ copyright. However, now it is a free for all on the German border and Reinhard Griebel, the great grandson of the founder of the firm, has just one workshop and the gnome museum. Whilst the original gnomes were depicted as gardeners engaged in the traditional rural tasks, the range was increased to include anyone from fishermen to musicians, sportsmen and farmers. It was not long before living individuals were being modelled in clay or stoneware. Among those currently available are gladiator Russell Crowe, TV gardeners Alan Titchmarsh and Charlie Dimmock and even a Tony Blair wall plaque. For gnome lovers no trip to Europe would be complete without a visit to the Gnome Reserve set in the wilds of northern Devon in England. There you will find over one thousand gnomes and pixies in the four acre reserve. Gnome hats are loaned free of charge together with fishing rods, so you don’t embarrass the gnomes! There are some who view the cheerful little character sitting in your yard in a different light. FreeTheGnomes.com provides Garden Gnome Liberation information and calls to action. They proclaim that “Thousands of Gnomes are enslaved in Gardens across America. For too long we have let our neighbors usurp the rights of these gentle woodland creatures. Join our boycott. Organize a picket demonstration. Write to Congress. Free a Gnome. We’ll show you how.” Some groups have taken the law into their own hands. In April 2000 in Paris the dormant Garden Gnome Liberation Front sprang back to life, stealing about 20 gnomes during a nighttime raid on a Paris exhibition. “We demand … that garden gnomes are no longer ridiculed and that they be released into their natural habitat,” the Front’s Paris wing said in a statement following its weekend strike. Disappearing gnomes have caused headaches for police forces worldwide. In May 2004 The Scotsman reported that a spate of bizarre thefts had left Lothians police with several unusual prisoners - 14 garden gnomes. An elderly woman complained to police that someone was stealing gnomes from her yard in Fairfax County, Washington D.C. Officers set up a spy-cam and caught their suspect in the act four times. Police revealed that their bad guy was really a not-so-bad Labrador retriever named Magnum. The dog had been retrieving the figurines and bringing them home. In Australia, garden gnomes started disappearing from one particular neighbourhood on a large scale. They were found in a clearing in the bush months later, where they were all gathered around the largest gnome, having a meeting. If you have not yet succumbed to the temptation to acquire one of these cheerful little creatures, let me leave you with one final thought. A study carried out in England in 2003 into matters to be considered when selling your home found that having a gnome in your front garden reduced the value of your house by $840.
